Terms & Conditions

1. All returned merchandise must be returned within 10 days of purchase.  Returns subject to up to a 50% restocking charge and MUST BE accompanied by this invoice.
2. No refunds or returns of special-order items
3. Goods ordered and not picked up or delivered within 45 days of arrival at Kenyon Noble Lumber Company (“Kenyon Noble") will be subject to a 15% holding fee per month.  After 6 months, Kenyon Noble has the right to dispose of such goods, in any manner they elect, even if the goods have been paid for.  Customer will only be entitled to receive the net proceeds received from any sale of the goods, if any, after payment of all outstanding holding charges.
4. Kenyon Noble makes deliveries inside the curb/property line and/or as close to the job site, at customer’s directions only, and only as we feel safe and practical. “Company” drivers have final and sole discretion as to delivery location.
5. All accounts are due on or before the 10th of the month.  Finance charges will be assessed against past due accounts at the maximum rate allowed under MCA § 31-1-107, minimum $1.00.
6. Customer agrees to pay all attorney fees and collection costs if payment is not received on a timely basis.
7. Kenyon Noble will not be liable for any customer vehicle or trailer damage due to loading and unloading.
8. This Agreement is deemed to be made in Montana. Customer and Kenyon Noble expressly agree this Agreement is to be governed by Montana Law and jurisdiction shall be proper in Gallatin County, Montana.
9. Kenyon Noble warrants that goods sold hereunder are merchantable and that Kenyon Noble conveys good title thereto. IN NO EVENT WILL KENYON NOBLE BE LIABLE FOR CONSEQUENTIAL, SPECIAL, EXEMPLARY, PUNITIVE, OR INCIDENTAL DAMAGES EVEN IF CUSTOMER HAS NOT BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. EXCEPT FOR THE EXPRESS WARRANTY STATED IN THIS PARAGRAPH, KENYON NOBLE GRANTS NO WARRANTIES, EITHER EXPRESS OR IMPLIED HEREIN, INCLUDING ALL IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE, AND THIS STATED EXPRESS WARRANTY IS IN LIEU OF ALL LIABILITIES OR OBLIGATIONS OF KENYON NOBLE FOR DAMAGES INCLUDING BUT NOT LIMITED TO,  CONSEQUENTIAL, SPECIAL, EXEMPLARY, PUNITIVE, OR INCIDENTAL DAMAGES OCCURRING OUT OF OR IN CONNECTION WITH THE USE OR PERFORMANCE OF ANY GOODS SOLD HEREUNDER. Kenyon Noble specifically does not warrant the accuracy of sufficiency of any advice or recommendations given to customer in connection with the sale of goods hereunder.
